This Privacy Notice describes how John B. Conomos, Inc. (“we,” “us,” or “our”) may access, collect, store, use, transfer and/or disclose your personal information when you visit and use our website at http://www.conomos.com (the “Site”). This Privacy Notice does not apply to information we collect, store, use, transfer and/or disclose of job applicants or current or future employees, including information submitted by you to us using the “Send Us Your Resume” web form found on our Site. Such information is covered by different notices and terms.

1. WHAT INFORMATION DO WE COLLECT?

We or our service providers, on our behalf, may collect some or all of the following categories of information from you depending on how you interact with our Site. As more specifically detailed below, we collect information provided by you and automatically when you use the Site.

Information Provided by You. We collect information that you voluntarily provide to us when you fill out an online form, subscribe to our newsletter, or otherwise when you contact us via the Site. The information that we collect depends on the context of your interactions with the Site, the features you use, and the information you choose to provide. The information we collect may include the following:

  • Direct Identifiers. Information such as your name or online identifier.
  • Contact Information. Information such as your phone number, email address, or mailing address, or company name.
  • User Content. Information such as your communications with us, including the body of the message you send and date and time of message, and any other content you provide, including project specific information such as drawings, images, and materials.

Information Collected Automatically. We automatically collect certain information when you visit, use, or navigate the Site, using various technologies such as session replay, cookies, and pixels. For more information related to our use of tracking technologies, see Section 5 below. The information we collect includes:

  • Device Data. Information about your computer, phone, tablet, or other device you use to access the Site, such as your IP address (or proxy server), device and application identification numbers, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Log and Usage Data. Information about your interaction with the Site, such as the date/time stamps associated with your usage, pages and files viewed, searches, the frequency and access to the Site, and other actions you take such as which features you use.
  • Location Data. Information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Site. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information by disabling your location settings on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Site.
  • Demographic Information. Information such as your gender, age, and related information.
  • Social Media Platforms and Networks. The Site may include social media features and plugins, such as Facebook and LinkedIn widgets. These plugins may use cookies or other tracking technologies to collect information automatically. Such social media features are hosted by third parties and your interactions with those features are governed by the privacy notices of the companies that provide them.

Notice of Collection of Sensitive Information. Several of the categories of information that we collect and process may include “sensitive” personal information, including:

  • Location Data. Location information, to the extent that it reveals your precise geolocation may be considered sensitive personal information.
  • Demographic Information. Information such as that about your gender expression, gender identity, age, and related information may be considered sensitive personal information.

2. HOW DO WE USE YOUR INFORMATION?

We use your information for a variety of business purposes, including to:

  • To respond to your inquiries and offer support services. We may use your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may use your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We may use your information to fulfill and manage your orders, payments, returns, and exchanges and otherwise provide our services.
  • To request feedback. We may use your information when necessary to request feedback and to contact you about your use of our services.

3. HOW DO WE DISCLOSE YOUR INFORMATION?

We may disclose your information in the following situations:

  • With Your Consent. We may disclose or make available your information with your consent, which may be obtained in writing, online, through “click-through” agreements, indicated when you choose to submit information through the Site, or by other means.
  • With Service Providers. We may disclose or make available your information with third parties to provide services to us and/or on our behalf, such as credit/debit card processing partners, customer service providers, data analytics providers, advertising and marketing providers, third-party auditors and law firms, website hosting services, etc.
  • With Google Maps Platform APIs. We may disclose your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors.
  • In Exigent Circumstances. We will disclose information about you: (1) if we are required to do so by law or legal process, such as for compliance with law enforcement or national security requests, court order or subpoena; (2) to law enforcement authorities, judiciary or other government officials; (3) if necessary to protect your, our or others’ rights, property, safety, or other vital interests; (4) enforce our policies or contracts and otherwise comply with our legal obligations; (5) collect amounts owed to us; or (6) when we believe, in good faith, disclosure is necessary or appropriate to prevent physical harm or financial loss in connection with an investigation or prosecution of suspected or actual illegal activity.
  • In Case of a Business Transaction. In the event that all or a portion of John B. Conomos, Inc., our business, our services, or our assets are acquired by or merged with a third-party as part of a business transaction, such as a merger, acquisition, joint venture, financing, corporate reorganization, or purchase or sale of our assets, or in the unlikely event of insolvency, bankruptcy, or receivership, your information may be sold or transferred to that third-party as part of such a transaction, including at the negotiation stage, as permitted by law and/or contract.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We, as well as third parties and service providers that provide content, advertising, or other functionality on the Site, may use tracking technologies, including session replay technologies, to gather information when you interact with our Site for purposes that fall into the following general categories:

  • Strictly Necessary. This includes technologies that allow you access to our Site, to identify irregular site behavior, prevent fraudulent activity and improve security, or allow you to make use of our functionality;
  • Performance Related. We may use technologies to assess the performance of our Site, including as part of our analytic practices to help us understand how our visitors use the Site, its pages, and its features;

  • Cookies. A cookie is a small text file that is placed on your computer and stored by your browser. The purpose of cookies is to make our Site more user friendly, effective, and more secure. We use two types of cookies on our Site: session cookies and persistent cookies. Session cookies are automatically deleted after you leave our Site. Persistent cookies will remain archived on your device until you delete them. These cookies enable us to recognize your browser the next time you visit our Site.
  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Site, advertisements, and email communications that collects information about users’ engagement on the Site or with that communication. There are various types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). When you access a website, video, email, or advertisement that contains a pixel, the pixel may permit us or a third party to collect data through your device and browser. Pixels are used in combination with cookies to track activity by a particular browser on a particular device. We may incorporate pixels from separate entities that allow us to track our communications, bring you advertising both on and off our Site, and provide you with additional functionality.
  • App Technologies. We use third-party APIs and software development kits (“SDKs”) as part of the functionality of our Site. 5. HOW LONG DO WE KEEP YOUR INFORMATION?

We will keep your information for as long as it is reasonably necessary to achieve the purposes described in this Privacy Notice, or any other notice provided at the time of collection, taking into account applicable statutes of limitation and records retention requirements under applicable law or policy. We may also keep your information for longer retention periods where there is a reasonable basis for retaining such information, including without limitation in connection with the establishment, exercise, or defense of legal claims.

6. HOW DO WE PROTECT YOUR INFORMATION?

We take commercially reasonable steps measures to ensure that the information we collect, use and process is managed securely and in accordance with this Privacy Notice. However, despite our efforts to secure your information, no electronic transmission over the Internet, wireless network, or any information storage technology can be guaranteed to be 100% secure. Although we take such commercially reasonable steps to protect your information, your transmission of information to us and from our Site is at your own risk. You are also responsible for taking reasonable steps to protect your information against unauthorized disclosure or misuse.

7. DO WE COLLECT INFORMATION FROM CHILDREN?

The Site is not directed at children under 18 years of age, and we do not knowingly collect or solicit data from or market to children. By using the Site, you represent that you are at least 18 years of age or the equivalent age of majority as specified by law in your jurisdiction. If we learn that we have collected information from users less than 18 years of age or the equivalent age of majority as specified by law in your jurisdiction, we will take steps to promptly delete such data from our records.

8. WHAT ARE YOUR PRIVACY CHOICES?

Withdrawing your consent: If we are relying on your consent to process your information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section ”HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below.

However, please note that this will not affect the lawfulness of the processing before you withdraw consent nor, when applicable law allows, will it affect the processing of your information conducted in reliance on lawful grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section ”HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. You will then be removed from the marketing lists. However, we may still communicate with you to send you service-related messages that are necessary to respond to service requests, fulfill and manage your orders, or for other non-marketing purposes.

9. DO-NOT-TRACK

Do-Not-Track (“DNT”) is a feature or setting you can activate in certain web browsers to signal your privacy preference not to have data about your online browsing activities monitored and collected. When you turn on DNT, the browser may send a signal or other message to web services requesting that they not track you. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online, and our information collection practices will continue to apply as described in this Privacy Notice. 10. JURISDICTION

John B. Conomos, Inc. is in the United States. Our Site is not targeted towards, nor is the Site intended for use by, individuals residing outside of the United States of America. John B. Conomos, Inc. does not represent or warrant that our Site is suitable for access or use outside of the United States and visitors accessing our Site from outside of the United States do so at their own risk.

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. By accessing or using our Site, you agree that all information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.

Except where prohibited by law, this Privacy Notice and any disputes arising out of or relating to it, including disputes regarding its interpretation, validity, or enforceability, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to any conflict of law principles or rules of Pennsylvania or any other jurisdiction that would cause the application of the laws of any other jurisdiction. Your use of the Site will constitute your consent and agreement to exclusive jurisdiction and venue in the state and federal courts located in Allegheny County, Pennsylvania, provided that a party may seek enforcement of a judgment of such courts in any court of competent jurisdiction.

We may update or otherwise revise this Privacy Notice from time to time in our sole discretion to reflect changes in our information practices and policies. The “Last Updated” date noted at the top of this Privacy Notice will indicate when this Privacy Notice was most recently revised. Except as may be otherwise required under applicable law, revisions to this Privacy Notice will be effective on the date noted above without any other notice or approval by you. Your continued use of the Site after a modification will constitute YOUR ACCEPTANCE OF THIS PRIVACY NOTICE, as modified. In certain jurisdictions, applicable law may require us to take additional steps, in which case, revisions to this Privacy Notice will not be effective until we have met our obligations accordingly.
